The General rule is You are eligible for H1B extn if the following conditions are met

a) Labor applied on your behalf atleast 1 yr prior to maxout date. You will be eligible for 1 yr extensions

b) Labor and I-140 approved in that case it will be 3 yrs extensions

Now I was in similar situation where in i applied for labor in 6th yr, Labor got cleared in 2 months, I-140 got cleared in 2.5 months so now i am eligible for 3 yr extn.

These days Labor certifications are taking a bit longer time (Atlanta is the only place they are doing it ) So it may take more time. Also one another thing needs to be considered is if there is any RFE then it takes longer.( Few cases pending beyond a year)

Do a research on various RFE and do your paperwork in much more details you will probably end up without any RFE on your case

My information:

Priority Data: March 2008
I-140 approved
About to apply for 3 year extension of H1B after 6th year( which expires on Dec 1st 2011)

My Questions
----------------------
If I move to another company as soon as my 3 year H1B extension comes through and they start my GC process again, what do I have to be careful about regarding
1. Is this even possible?
2. Will the H1B keep getting extended after I switch employers.
3. Can I keep my PD?
4. If the new company is in a slightly different field but my job remains similar, does that matter?
5. What happens if after I transfer, my current employer revokes my i-140? Does that matter since my new employer will restart my GC process anyway? (Also, do i get to keep my PD in this case?)

Hi

After changing the address on sunday, there were soft luds for 2 days on all pending 485.

Is this same with all address change.Last time it took 3 weeks to get the letter.

Any experiences?

I (and my spouse as dependent) applied for I-485, AP, and EAD on July 17, 07 and am yet to get the receipt notice. My (and my spouse's) H-1 expires on 12/31/07 and I plan to travel out of the US between November 8 and December 24.

In case, the I-485 receipt notice does not come before we leave, would we be considered as having abandoned the PR application? Any idea how long it might take for the receipt notice to come for people in my shoes?

Hi All,

I applied for Labor in EB2 category in Oct 2007. It was pending for 2 yrs and 2 days back my employer mentioned that they see my Labor status as denied and that they have not received any denial letter yet.

My H1 will expire in early Jan 2011, so I practically have around 365 days from now to apply for a new Labor. My questions are

1. Should I re-appeal?
2. Do Labors get approved in re-appeal?
3. Can I start a new Labor application with the same employer simultaneously?
4. What�s a safe category to apply at this point in time. EB2 or EB3?

I don't think there are any adverse effects of updating them with correct address, I applied for 485 in July moved end of august and updated my address with them, All my Receipts and EAD and biometric were returned to them and they resent them to new address with a thank yo note for updating address.

jus FYI...I didn't file AOS, so thats why I'm worrying to change the employer with the approved 140.

My new employer (Company "B") ready to start the process again, but would like to keep this PD.

Dear my friends Can I get copy of LC filing copy and 45 letter copy through
FOIA? I recently got laid off after working 4 years in same company. My employer is refusing to give LC filing copy. In my knowledge to get new H1 as I am 8th year extension from my new employer, I need to have copy of LC filing. I am in dilemma; please guide me if you can. Adding one more question

Can employee pay 140 premium processing fees ?


This is my understanding PERM has no fees to department of labour. Is that right ?
Can employee may attorney fees for PERM ?
Can employee pay I-140 fees for USCIS ?
Can employee pay I-140 fees to attorney ?
I assume that employee can surely pay for USCIS-485 fees and attorney fees for this. ?

My current H1 expires on the 30th of September 2007. I have applied for H1 extension under premium processing and it is pending.

My Query is:

Can I work after my H1 expires on the 30th and my H1 extension is still pending? i.e. continue working based on a pending H1 application? If so, for how long?

If the H-1 was filed as a COS you will have to join the H-1 company on October 1, as you will no longer be on L-1 on that date. If you H-1 is filed for consular processing, then you dont have to worry, whenever you are ready you can go to the consulate in your home country, get a visa and come back on H-1b status.

I am planning to get my H1 stamped during my next trip to India and have a couple of questions

1) Have anyone used Yourmaninindia or Sahara Care or any other service to deposit H1 forms at VFS Mumbai. For Mumbai consulate, the forms need to be submitted 3 days prior to Visa Interview and they do not accept courier :mad:

2) I recently found that if you have an appointment at one of the consulates in Mexico, you can Fax the 797 and get PMIS verified in advance.
Do we need to submit the entire H1 fee for appointment ? If there is a cheaper way, I am thinking of taking an appointment , get PMIS verified and cancel the appointment.

3) Any idea if they do a PMIS verification for H1 extensions (same company) as well ?

I am hoping this helps. My H1 renewal 7th year came through in December effective January 10 2010. I was at the Mumbai consulate interviewing for H1 visa on January 21st and received my passport in hand in 3 business days.
