My lawyer informed this. They instructed me not to travel while extension is pending. In case you have to travel, they suggest to do the extension after return back. I don't have any source for this information.
But it makes sense isn't it. Your extension is the extension of your last I94, however if you travelled after application, your extension have different i94 number and your recent i94 has different number. Just my opinion.

Hi,
Can you tell me what your lawyer sent to the USCIS. How did he link the approved 140 to the pending 485. Did he fill any form? I am in the same boat. My both 140's are with the same company though.

Whatever my Lawyer has done , has not worked so far, I guess he sent copies of both I140's and a letter requesting to use the EB3 PD with the EB2 case.

Please let me know the procedure you followed for filing AC21. Did you go through your own attorney?
I am going to file AC21, haven't done yet. My lawyer was more inclined towards going with EAD rather than H1 transfer in first place. I am still in negotiations with the new employer.

does anyone know when CIR will be discussed in the house and in the Senate?
Senate taking it up in the last 2 weeks of May. House has not scheduled debate on CIR yet, I believe. Supposedly this is the quiet before the storm. I believe a lot of backstage deal-making and negotiating is going on to get bipartisan support for CIR.

If you look closely its for the I-484 stage. I have also been told that the first stage has to be apporved. So the first I-140 has to be approved (earlier priority date). The word 'subsequent' is throwing the confusion around.
I think this is not fair since lot of people have their earlier petition being approved after their second petitions (due to perm and premium I-140).

Yes. Its simple math. But if it was 10K visas a year, then why did they have to jump forward by more than 2 yrs? Nobody knows how USCIS works internally. The math that v have and the one that they have differ a lot and unexpected things (for good or bad) happen all the time.
in 1999-2000 ISNAmerica group was formed by immigrants affected by backlogs...it dissipated with the AC21 rule being passed...I hope and pray that immigrationvoice does not go away like that... I am still using H1 ( valid thru sept 09 ), and have EAD ( AOS pending ) under EB3 ( PD is Oct 2003). Still with same company.
Over years my responsibilities increased, ( DBA to DataArchitect ) and 1 new employee reporting to me. Will these factors help me move to EB2 ? what will be the procedure?
Please advice.

No reason to deny your 7th year H1 extension based on the fact that it is for a different role. It DOESNT have to be "same or similar" for this case.
But the "same or similar" comes into picture for your 485 approval. Well........ at that time ... if the original LC position is still available for you permanently, no issues.
What happens to the GC petition? I guess that is probably also Amit's concern in the long term

As per the document:
total EB2 visa available: 40040
Grand total of EB2 pending: 33850
So, technically all the EB2 applicants should get their GC during the fiscal year of 2011. Even in the situation where no fall down from EB1.
Seems like good news for many and hopefully foir EB3s as well if further fall down of visas occur.
Guess, USCIS should wake up and move the dates faster instead of jungling during last quarter of the fiscal year.
